KHET, a Limited Liability Partnership incorporated under the Limited Liability Partnership Act 2013, with its registered office located at Plot No G-184 and 185 Begumpur Khno 74/15 Ground Floor North West Delhi -110086, India, offers these services through the website and mobile application (collectively referred to as "Website"). 

KHET FRAGRANCES LLP wishes to clarify that we operate solely as a retailer and distributor of perfume products and not as a manufacturer. We do not engage in the manufacturing, formulation, or production of any perfumes or fragrances sold on our website or through our distribution channels. All perfume products offered by us are sourced exclusively from third-party manufacturers who possess valid licenses under the Drugs and Cosmetics Act, 1940 and comply with the Cosmetics Rules, 2020, including holding appropriate manufacturing licenses (Form COS-8) issued by the relevant State Licensing Authority. While provisions of the Drugs and Cosmetics Act, 1940 and Cosmetics Rules, 2020 that apply to manufacturers are not directly applicable to our operations as a retailer, we ensure that all products we sell are manufactured in compliance with these regulations. We maintain proper documentation and verification of our suppliers' compliance with applicable laws to ensure the quality and safety of all products offered to our customers

We make every effort to accurately display our products online, but we cannot guarantee that the colors, styles, or packaging of products on the Website will exactly match what you see on your device.

Payment and Fees

When you purchase products from KHET FRAGRANCES LLP, you agree to pay the listed price of the items inclusive of all taxes.

If your payment is not processed successfully, KHET FRAGRANCES LLP reserves the right to cancel your order.

Return and Refund Policy

1. Cancellation Policy

You may cancel your order at any time before shipment without incurring any cancellation charges. For cancellations after shipment has been initiated. If the cancellation is initiated by you, reasonable cancellation charges may apply to cover shipping and handling costs already incurred.

 If the cancellation is initiated by KHET FRAGRANCES LLP, we will bear all costs associated with the cancellation and provide a full refund. Any cancellation charges imposed will be reasonable and proportionate to the actual costs incurred by KHET FRAGRANCES LLP. We will clearly communicate these charges before you finalize your purchase. To cancel an order, please contact our customer service team at [support email/phone] with your order number and cancellation request.

2. Return Policy

Due to the nature of our perfumes and strict hygiene and safety standards, we cannot accept returns or exchanges once a product has been opened or used, as these items cannot be resold or reused. Exchanges are only offered for defective products—such as a damaged or malfunctioning spray pump, leakage, or incorrect fragrance—reported within 15 days of delivery. Pump damage reported within 15 days of first use will also be eligible for exchange upon verification. We do not exchange non-defective products, and we appreciate your understanding and cooperation.

Please note that any damage arising from improper storage or negligence will not fall under this policy. If you have sensitive skin or allergies, we strongly recommend doing a patch test before regular use, as specified on each product.

3. Refund Policy

KHET FRAGRANCES LLP will not be responsible for any damage reported after delivery, unless it meets the rare case conditions and is supported by required evidence. To process any claims regarding missing items, leakage, breakage, or incorrect products, we require an unboxing video clearly showing the original packaging and the issue.

If you face any such concern, please reach out to our customer care team at care@khet.in:

  3. A brief description of the issue

If the package appears tampered with or visibly damaged, we request you to refuse the delivery and report it to us immediately. If your order is marked as "delivered" but hasn't been received, please contact us within 3 days of the status update. Unfortunately, we won't be able to entertain refund claims post this period.

Please note:

  1. Delivery charges are non-refundable, as they are retained by the logistics partners.

  2. Cash on Delivery (COD) refunds, where approved, will be processed to the customer's provided bank account within 4-7 working days.

  3. Refund claims must be submitted within 24 hours of delivery to be eligible for consideration.

If approved, your refund may take up to 15 days from the date of acceptance to reflect in your account. We will provide all relevant details, including transaction ID and confirmation screenshots, once your refund is initiated.

Shipping and Delivery

KHET FRAGRANCES LLP ships to select regions. Delivery charges and times may vary based on your location.

We strive to deliver products in a timely manner, but KHET FRAGRANCES LLP is not responsible for delays caused by third-party carriers, customs, or other factors outside our control.

Intellectual Property

All content on the Website, including text, images, logos, and trademarks, are the property of KHET FRAGRANCES LLP or its licensors and are protected by copyright, trademark, and other intellectual property laws of India.

KHET FRAGRANCES LLP does not ensure or guarantee continuous, error-free, secure or virus-free operation of the Portal or availability of any facility on the website.

Additionally, KHET FRAGRANCES LLP does not promise or ensure that you will be able to access your user account or obtain Services whenever you want. It is entirely possible that you may not be able to access your user account or the Services provided by KHET FRAGRANCES LLP at times or for extended periods of time due to, but not limited to, system maintenance and updates.

Our perfumes may contain alcohol and are for external use only, NOT for consumption. These products are not intended to diagnose, cure, mitigate, treat, or prevent any disease. No liability will be assumed by KHET FRAGRANCES LLP arising out of the misuse or otherwise of our products.

Limitation of Liability

In addition to specific references to limitation of liability of KHET FRAGRANCES LLP elsewhere in the Terms, under no circumstances (including, without limitation, in contract, negligence or other tort), KHET FRAGRANCES LLP shall be liable for any injury, loss, claim, loss of data, loss of income, loss of profit or loss of opportunity, loss of or damage to property, general damages or any direct, indirect, special, incidental, consequential, exemplary or punitive damages of any kind whatsoever arising out of or in connection with your access to, or use of, or inability to access or use, the Goods on any Portal. You further agree to indemnify us and our service providers and licensors against any claims in respect of any such matter.

Product Liability: KHET FRAGRANCES LLP ensures that all products sold on our platform meet quality standards and comply with applicable regulations. While we operate as a retailer and not a manufacturer, we take reasonable steps to verify the quality and authenticity of all products we sell. 

We provide accurate and complete information about our products, including composition, usage instructions, and safety information. Any disclaimers or warnings provided by manufacturers are prominently displayed on product pages. 

If a product bottle is found to be broken, not as described, or not fit for its intended purpose, you are entitled to: - Return the product for a full refund - Request a replacement 

If you receive a broken bottle or a product which you didn’t order, please contact our customer service team immediately with details and supporting evidence (such as photographs) of the defect

To the fullest extent permitted by law, KHET FRAGRANCES LLP and its affiliates shall not be liable for any loss, injury, or damage arising from your use of the Website, products, or services, including, but not limited to, any errors, omissions, interruptions, or delays in the service.

Indemnification

You agree to indemnify, defend, and hold harmless KHET FRAGRANCES LLP, its affiliates, employees, officers, and agents from any claims, losses, liabilities, and expenses, including legal fees, arising from your use of the Website, violation of these Terms, or infringement of any third-party rights.

Governing Law, Dispute Resolution & Jurisdiction

The Terms and Privacy Policy shall be interpreted in accordance with the laws of India. The courts of competent jurisdiction at Delhi, India shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Services provided by KHET FRAGRANCES LLP, the construction, validity, interpretation, and enforceability of these Terms, or the rights and obligations of the consumer(s) (including participants) or KHET FRAGRANCES LLP, as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute referred to arbitration as given below. All such issues and questions shall be governed and construed in accordance with the laws of the Republic of India.

In the event of any legal dispute (which may be a legal issue or question) which may arise, the party raising the dispute shall provide a written notification ("Notification") to the other party. On receipt of the Notification, the parties shall first try to resolve the dispute through discussions. In the event that the parties are unable to resolve the dispute within fifteen (15) days of receipt of the Notification, the dispute shall be settled by arbitration.

The seat and venue of arbitration shall be Delhi, India. All arbitration proceedings shall be conducted in English and in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.

The arbitration award will be final and binding on the Parties, and each Party will bear its own costs of arbitration and equally share the fees of the arbitrator unless the arbitral tribunal decides otherwise. The arbitrator shall be entitled to pass interim orders and awards, including the orders for specific performance and such orders will be enforceable in competent courts1. The arbitrator shall give a reasoned award. The cost of Arbitration shall be borne by the parties seeking arbitration which shall be reimbursed by us if the fault can be attributed to Khet. 

Nothing contained in these Terms of Service shall prevent KHET FRAGRANCES LLP from seeking and obtaining interim or permanent equitable or injunctive relief, or any other relief available to safeguard KHET FRAGRANCES LLP's interest prior to, during or following the filing of arbitration proceedings or pending the execution of a decision or award in connection with any arbitration proceedings from any court having jurisdiction to grant the same. The pursuit of equitable or injunctive relief shall not constitute a waiver on the part of KHET FRAGRANCES LLP to pursue any remedy for monetary damages through the arbitration described herein.

Complaints, Grievances & Disputes

Before initiating formal legal proceedings, consumers are encouraged to contact our Grievance Officer at privacy@khetparfums.com to seek resolution of any disputes or complaints. Our Grievance Officer will acknowledge receipt of complaints within 48 hours and provide a resolution within 30 days. You accept that any complaints and disputes are and remain confidential both whilst a resolution is sought and afterwards. You agree that you shall not disclose the existence, nature or any detail of any complaint or dispute to any third party.

KHET FRAGRANCES LLP shall make efforts to resolve complaints within reasonable time. Our decision on complaints shall be final and binding on you.

Modifications and Alterations

We may alter or modify the Terms at any time without giving prior notice to you1. We may choose to notify of some changes in the Terms either by email or by displaying a message on the Portal; however, our notification of any change shall not waive your obligation to keep yourself updated about the changes in the Terms. Your continued use of any Portal and/or any Services offered constitutes your unconditional acceptance of the modified or amended Terms.

We may also post supplementary conditions for any Services that may be offered. In such an event, your use of those Services will be governed by the Terms as well as any such supplementary terms that those Services may be subject to.

Users may reject modified Terms by ceasing Platform usage and notifying KHET FRAGRANCES LLP within seven days of the update. If no action is taken within this period, Users will be deemed to have accepted the updated Terms.

Miscellaneous

KHET FRAGRANCES LLP may be required under certain legislations, to notify the consumer(s) of certain events. Consumer(s) hereby acknowledge and consent that such notices will be effective upon KHET FRAGRANCES LLP posting them on the Website or delivering them to the user through the email address provided by the user at the time of registration. Consumer(s) may update their email address by logging into their account on the Website. If they do not provide KHET FRAGRANCES LLP with accurate information, KHET FRAGRANCES LLP cannot be held liable for failure to notify the user.

KHET FRAGRANCES LLP shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, any failure to perform due to unforeseen circumstances or cause beyond KHET FRAGRANCES LLP's control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor or materials, etc. 

KHET FRAGRANCES LLP's failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

Consumers agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Website or these Terms must be filed within thirty (30) days of such claim or cause of action arising or be forever barred.

These Terms of Service, including all terms, conditions, and policies that are incorporated herein by reference, constitute the entire agreement between the consumer(s) and KHET FRAGRANCES LLP and govern your use of the Website superseding any prior agreements that any user may have with KHET FRAGRANCES LLP.

If any part of these Terms of Service is determined to be indefinite, invalid, or otherwise unenforceable, the rest of these Terms of Service shall continue in full force.

KHET FRAGRANCES LLP reserves the right to moderate, restrict or ban the use of the Website, specifically to any consumer, or generally, in accordance with KHET FRAGRANCES LLP's policy/policies from time to time, at its sole and absolute discretion and without any notice.

KHET FRAGRANCES LLP may, at its sole and absolute discretion, permanently close or temporarily suspend any Services.
